House on Hand

1. If you are a Vendor, our duty is to complete settlement on your behalf, attend to the repayment of existing Mortgage loans (if any) and arrange for the signing of the Transfer by you. We will provide you with a settlement statement setting out payments to the Agent of their professional fee and advertising expenses, our Conveyancing Fee, repayment of the Bank Mortgage loan, Government fees and payments and adjustments of Rates and Taxes to the date of settlement.

We will also attend to any other issues which may arise between the signing of the Contract and completion of settlement.

We will complete settlement at the Lands Titles Office in Adelaide and account to you for the proceeds of sale, which are generally deposited to your nominated account by Bank cheque. Banks will have a clearance time on the Bank cheque and funds may not be able to be accessed immediately.

2. If, in between the signing of the Contract and completion of settlement, you are moving house, changing your address or absent on holiday, please advise the Conveyancer accordingly – there will be Transfer documentation to be signed prior to settlement.

 
 
 

3. If you are holding the Certificate of Title, (there is no Mortgage), ensure that it is available, to be delivered to the Conveyancer or forwarded by Registered Mail upon request.

4. Should you have a Bank Mortgage secured against two properties, contact your Bank to seek the release of the property which has been sold and to negotiate the repayment amount.

5. Maintain the property in good repair and condition until settlement date.

6. Maintain household insurance until settlement, whereupon it may be cancelled.

7. Arrange final readings and advise change of address in respect of electricity, telephone, gas supply and pay television approximately one week prior to settlement. Your Conveyancer will arrange a final reading of the Water Meter, pay outstanding Rates and Taxes (Council Rates, Water and Sewer Rates, Emergency Services Levy, Land Tax and Strata Fees where applicable) and adjust to the date of settlement.

8. Settlements are generally completed at the Lands Titles Office, 101 Grenfell Street, Adelaide between 11.30 a.m. and 12.30 p.m. on the date of settlement. Conveyancers and Lending Institutions attend to complete settlement and lodge Transfer documentation with the Lands Titles Office for registration. You are not required to attend.

9. You will be required to provide vacant possession of your property to the Purchaser by no later than 12.00 noon on the day of settlement. This means having removed all items and leaving the property in a clean and tidy state.

10. Immediately following vacating the property, the keys should be handed to the Agent. The Agent will hand the keys to the Purchaser of the property following confirmation of completion of settlement from the Conveyancer.

11. Should you choose to sell without the assistance of an Agent and negotiate the transaction, we will prepare the Contract and Disclosure Statement on your behalf and thereafter complete settlement.
